The Impact of Criminal Sentencing Provisions
“Mandatory minimum” refers to minimum sentencing requirements for certain criminal offenses. All states have them, in large part because of the “war on drugs” which started largely in the 1980s. Have these mandatory minimum sentences actually reduced overall crime rates? That data is unclear.
What is clear is that the United States has the highest incarceration rate in the world, which has led to an overburdened prison system at a huge cost to taxpayers. But perhaps what has been most costly is the effect these mandatory minimums have had on families. Many believe that the mandatory minimum sentences are exorbitantly disproportionate to the crimes, and have done little more than perpetuate a cycle of criminal activity in poor and minority communities.
Without further commentary on the issue, take a look at Arizona’s mandatory minimum sentences –
